Legal Compliance
As a Landlord you have several important legal obligations. The most important of these concerns the safe condition of the property and it’s contents, it is vital that you comply with the relevant legislation. Non-compliance with the various laws and regulations is a criminal offence and carries penalties of up to a £5000 fine, 6 month’s imprisonment, or both. In the event of a death, charges could even extend to manslaughter. Obtaining and maintaining compliance with an ever changing raft of Government legislation is a challenge for even the most experienced and knowledgeable Landlord. Following these extensive checks the National Landlords Association issue a detailed report with a recommendation as to the acceptability of the tenant, and if necessary they will recommend a guarantor who will undergo the same checks. We only recommend successful applicants and can provide a low cost rental guarantee scheme under the auspices of the National Association of Landlords.

Income Tax liability – UK Resident
Where the Landlord is resident within the UK they are legally responsible to declare any profits made from property rentals on the property pages of their self-assessment tax return. While we can offer general advice on taxation matters we would always recommend seeking professional advice from an appropriately qualified professional.
Income Tax Liability – Landlords Resident Overseas
Under the Taxation of Income from Land (Non-residents) Regulation 1995 a non-resident Landlord must complete an NRL1 form requesting that rental balances are paid directly to him with no tax deducted.
Alternatively or in the absence of an exemption certificate we are legally obliged to deduct tax at the current basic monthly rate of 20% abs pay this directly to HRMC on a quarterly basis
